Harbourside Communications, Inc. (“we,” “us,” or “our”) provides SMS (Short Message Service) text messaging services (“SMS Services”) to communicate with individuals and businesses. These terms govern the use of our SMS Services and are intended to ensure compliance with the CTIA Messaging Principles and A2P (Application-to-Person) messaging requirements, including those enforced by U.S. mobile carriers and applicable federal and state laws.
By opting in to receive SMS messages from Harbourside Communications, Inc., you agree to these Terms of Use and our Privacy Policy.
1. Program Description Harbourside Communications, Inc. may send transactional, promotional, informational, customer support, and account-related messages via SMS. Messages may include but are not limited to:
- Appointment confirmations and reminders
- Service and product updates
- Billing notifications
- Marketing promotions and offers
- Customer satisfaction surveys
- Alerts related to account activity
- Operational updates or business announcements
2. Message Frequency Message frequency varies. You may receive multiple messages per day depending on your interactions with Harbourside Communications, Inc. and your opt-in status for various communication programs.
3. User Consent (Opt-In) To receive SMS messages from Harbourside Communications, Inc., you must:
- Provide explicit written consent (digital or physical)
- Opt-in via web form, keyword text (e.g., TEXT JOIN to 12345), or verbal consent documented in our CRM
- Consent is not a condition of purchase unless explicitly stated
4. Opt-Out Instructions You may opt-out of receiving SMS messages at any time by replying with one of the following keywords:
- STOP
- UNSUBSCRIBE
- CANCEL
- QUIT
- END
Upon receipt, we will send a final confirmation message and remove you from the messaging program(s) within a reasonable timeframe, generally within 1 business day.

6. Message and Data Rates Message and data rates may apply. Your mobile carrier’s standard messaging and data rates may be charged to your mobile account. Harbourside Communications, Inc. is not responsible for these charges.
7. Participating Carriers Our SMS program is supported by major U.S. mobile carriers, including AT&T, Verizon, T-Mobile, and others. However, message delivery is not guaranteed, and participation from all carriers may vary.
8. Privacy and Data Use Your privacy is important to us. By providing your mobile number, you agree to our collection, storage, and use of your data as described in our Privacy Policy. We do not sell or share your data with third parties for marketing purposes without your consent.
- Data collected may include your name, phone number, interaction history, preferences, and service data.
- We store data securely using industry-standard encryption and access control.
- Data may be used to personalize communications and improve our services.
9. Age Restrictions You must be at least 18 years of age to use our SMS Services. If you are under 18, you must obtain the consent of your parent or legal guardian.
10. Security of Your Information We implement technical and organizational measures to secure SMS communications and protect against unauthorized access, disclosure, or misuse. However, no transmission method over SMS is 100% secure.
11. Abuse and Prohibited Use You agree not to use our SMS Services for:
- Sending unlawful, abusive, or harassing content
- Fraudulent purposes or impersonation
- Violating third-party rights or laws
- Sending spam or commercial messages not explicitly authorized by Harbourside Communications, Inc.
Any such abuse may result in immediate termination of access to SMS Services and potential legal action.
12. Changes to These Terms We reserve the right to change these Terms of Use at any time. If changes are material, we will notify you via SMS or email, or by updating this page with a revised effective date. Continued use of SMS Services after such updates constitutes your agreement to the revised terms.
13. Disclaimers and Limitation of Liability SMS Services are provided “as is” and “as available”. Harbourside Communications, Inc. makes no warranties regarding the availability, timeliness, or accuracy of SMS messages. We are not liable for delays, message failures, or other errors caused by carrier networks or technical issues.
To the fullest extent permitted by law, we disclaim all liability arising from or related to:
- Missed or delayed messages
- Unauthorized access to your information
- Any damages resulting from the use or inability to use the SMS Services
14. Governing Law These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
